Chúng tôi, những người và tổ chức ký tên dưới đây, cho rằng cuộc bầu cử Đại biểu Quốc hội và Hội đồng Nhân dân các cấp nhiệm kỳ 2026–2031 tại Việt Nam vào ngày 15 tháng 3 năm 2026 là không tự do, không công bằng, không minh bạch, và không đại diện cho ý chí và nguyện vọng của nhân dân. Vì vậy, theo quan điểm của chúng tôi, Quốc hội và Chính phủ được hình thành từ kết quả của những cuộc bầu cử này không là đại diện có tính chính danh của nước Việt Nam.
Lý do: Trong cuộc bầu cử này, Đảng Cộng sản là lực lượng duy nhất được phép đề cử ứng cử viên. Đảng Cộng sản cũng là lực lượng duy nhất đóng vai trò tổ chức bầu cử, kiểm phiếu, và công bố kết quả. Đảng Cộng sản cũng là lực lượng duy nhất, được hiến định theo Điều 4 Hiến pháp (một hiến pháp do đảng Cộng sản tự biên soạn và tự chuẩn thuận), để lãnh đạo Việt Nam. Trong khi đó, đảng Cộng sản chỉ có vỏn vẹn chưa tới 5 triệu đảng viên, tức chiếm chưa tới 5% dân số quốc gia.
Trong những điều kiện như vậy, tiến trình bầu cử không thể được coi là thực sự mang tính cạnh tranh, công bằng và đại diện cho ý chí của toàn thể nhân dân Việt Nam.
Chúng tôi cho rằng một cuộc bầu cử tự do, công bằng, minh bạch và đại diện cho ý chí của người dân chỉ khi nó thoả mãn ít nhất các tiêu chí sau đây:
Thứ nhất, Hiến pháp phải được sửa đổi để bảo đảm rằng các đảng phái khác có đầy đủ các quyền lợi và nghĩa vụ, một cách công bằng, như đảng Cộng sản.
Thứ hai, một tổ chức độc lập, với tinh thần phi đảng phái, sẽ tổ chức các cuộc bầu cử. Tổ chức này sẽ đưa ra các quy định minh bạch, công khai, và không thiên vị cho bất cứ ứng viên của đảng phái nào.
Thứ ba, tất cả các đảng phái, một cách công bằng, tự do hoạt động, đề cử và tranh cử, dựa trên các quy định chung.
Thứ tư, người dân bầu trực tiếp người đứng đầu chính quyền các cấp và người đại diện cho mình ở các cơ quan lập pháp.
Và thứ năm, các cuộc bầu cử phải có sự giám sát của các tổ chức quốc tế.

Statement of Protest Against the Results of the Election of Deputies to the National Assembly and People’s Councils for the 2026–2031 Term in Vietnam
We, the undersigned individuals and organizations, declare that the election of deputies to the National Assembly and People’s Councils at all levels for the 2026–2031 term, held on March 15, 2026, in Vietnam, was neither free, fair, nor transparent and therefore cannot be regarded as reflecting the genuine will and aspirations of the Vietnamese people. Consequently, we maintain that the National Assembly and Government formed on the basis of these election results lack democratic legitimacy to represent the Socialist Republic of Vietnam.
Reasons
In this election, the Communist Party of Vietnam was the sole entity permitted to nominate candidates. The Party was also solely responsible for organizing the election, administering the voting process, counting the ballots, and announcing the results.
Furthermore, under Article 4 of the Constitution—drafted and adopted under the authority of the Communist Party—the Party is granted the exclusive leadership role over the state and society in Vietnam. Meanwhile, the Communist Party has fewer than five million members, representing less than five percent of the country’s population.
Under such conditions, the electoral process cannot be considered genuinely competitive, impartial, or representative of the Vietnamese people as a whole.
We therefore affirm that an election can only be regarded as free, fair, transparent, and truly representative of the people’s will if it satisfies, at a minimum, the following conditions:
First, the Constitution must be amended to ensure that all political parties are granted equal rights and obligations under the law, on the same legal basis as the Communist Party.
Second, an independent and non-partisan electoral body must be established to administer elections. This body must operate under transparent, public, and impartial regulations that do not favor any political party or candidate.
Third, all political parties must be permitted to operate freely and equally, to nominate candidates, and to conduct political campaigns in accordance with uniform electoral regulations.
Fourth, citizens must have the right to directly elect the heads of government at all levels, as well as their representatives in legislative bodies.
Fifth, elections must be subject to independent monitoring by international organizations to ensure transparency and integrity.
